Terms and conditions

These terms are an agreement between you and Pullwise Ltd ("Pullwise", "we", "us"), Company registration number [to be confirmed], [Registered address to be confirmed]. They apply when you use the Pullwise website, portal and review service (the "Service"). If you use the Service for an organisation, you accept these terms on its behalf and confirm you are authorised to do so.

1. The Service

Pullwise reviews merge requests and pull requests on source-control platforms you connect, using an AI model you choose, and posts the results as comments. Reviews are produced automatically by AI and are advisory. They may be incomplete or wrong. You remain responsible for reviewing, testing and deciding what code you merge and deploy.

2. Accounts and workspaces

• You must give accurate sign-up details and keep your sign-in details secure.
• Workspace admins control who can join, members' roles and the workspace's settings, and are responsible for members' use of the Service.
• You must be at least 18 and using the Service for business or professional purposes.
• Tell us straight away at support@pullwise.ai if you think your account has been compromised.

3. Your content and connected services

"Customer Content" means the code, diffs, merge request text and other data the Service accesses from your connected platforms, and the reviews generated from it. You keep all rights in your Customer Content. You give us a limited licence to access, process and transmit it only to provide, secure and support the Service.

You confirm you have the right to connect the repositories and platforms you connect, and to have their content processed as described in our privacy policy.

When you use your own AI provider or a self-hosted model, Customer Content is sent to that provider or endpoint under your own agreement with them. We are not responsible for third-party providers you choose.

We do not use Customer Content to train AI models.

4. Credits, payment and refunds

• Reviews that use your own AI key or self-hosted model are free unless we tell you otherwise with at least 30 days' notice.
• Reviews on the Pullwise-hosted model use prepaid credits, metered by the tokens each review uses. Current prices are on our pricing page.
• Credits are paid for in advance through our payment provider, Stripe. Prices exclude taxes, which are added where required.
• Credits do not expire while your workspace is active and have no cash value. Unused credits are non-refundable except where required by law or if we end the Service without cause, in which case we refund unused credits.
• If your balance runs out, hosted reviews pause until you top up.

5. Acceptable use

You must not:

• break the law or infringe anyone's rights through the Service;
• try to access other workspaces, bypass security or limits, or probe or attack the Service;
• reverse engineer the Service except where the law allows it;
• use the Service to build a competing product, or resell it without our written agreement;
• send malware or content designed to harm the Service or its users; or
• overload the Service, or use automated means to access it other than through its intended interfaces.

6. Availability and changes

We work to keep the Service available and secure but do not guarantee it will be uninterrupted or error-free. We may change or improve the Service. If we make a change that materially reduces its functionality, we will give reasonable notice.

7. Intellectual property

We own the Service, including its software, design and branding. These terms do not give you any rights in it other than the right to use it under these terms. If you send us feedback, we may use it without obligation to you.

8. Confidentiality and security

We treat Customer Content as confidential and protect it with appropriate technical and organisational measures, described on our security page. Where we process personal data on your behalf, our data processing terms apply; contact legal@pullwise.ai for a copy.

9. Suspension and termination

You can stop using the Service at any time by disconnecting your integrations, and ask us to delete your workspace. We may suspend or end your access if you seriously or repeatedly breach these terms, if required by law, or to protect the Service or other users. Where reasonable we will tell you first. Sections 3, 4, 7, 10, 11 and 13 survive termination.

10. Disclaimer

Except as expressly stated in these terms, the Service is provided "as is". To the extent the law allows, we disclaim all implied warranties, including fitness for a particular purpose. AI reviews may miss defects or flag issues that do not exist, and you should not rely on them as your only form of code review or security testing.

11. Limitation of liability

Nothing in these terms limits liability that cannot legally be limited, including for death or personal injury caused by negligence, or for fraud.

Subject to that, neither party is liable for any indirect or consequential loss, or loss of profit, revenue, data or goodwill. Our total liability arising from or in connection with these terms in any 12-month period is limited to the greater of the amount you paid us in that period and €100.

12. Changes to these terms

We may update these terms. We will give at least 30 days' notice of material changes by email or in the portal. If you continue to use the Service after a change takes effect, you accept the new terms.

13. Law and disputes

These terms are governed by the laws of Malta, and the courts of Malta have exclusive jurisdiction, without affecting any mandatory rights you have under the law of where you are based.
